The recent case of Al Hassan (Article 8, entry clearance, KF (Syria)) [2024] UKUT 00234 greatly assists extended family members seeking to join their UK based family.
This case confirms that where a family life exists, the rights of the family members overseas must be considered and it is wrong to focus only on the UK based sponsor. The Upper Tribunal in this case concluded that the refusal to grant entry clearance to Syrian siblings and their family members was unlawful.
