Spouse, Civil Partnership, Unmarried Partners, Same Sex Partner Visas (Settlement visas)

These types of visas are for Spouses, Civil Partners, Unmarried Partners and Same Sex Partners who intend to join their spouses or partners who are either British Citizens or Persons with Indefinite Leave to Remain (ILR) living in the UK, or returning to the UK.

Those applying for this visa will be able to live and work in the UK for the duration of their leave and may be able to apply for Indefinite Leave to Remain (ILR) after 5 years.

People already in the UK may also be able to apply for leave to remain in the UK as Spouses, Civil Partners or Unmarried Partners, by switching from a different immigration category. In many cases we have successfully assisted people in the UK who are overstayers to secure leave to remain based on human rights arguments.

In certain circumstances, dependant children of the applicant can apply for settlement at the same time.

Applicants must satisfy stringent eligibility requirements and submit specified documentary evidence. The strict financial requirement in particular has been the subject of much litigation and criticism. Our immigration solicitors have specialist training in this area and are best placed to guide you through the process.

Applicants must also prove that they satisfy the English language requirement. To do so, the applicant must sit an approved test, by an approved provider at an approved test centre. It is important to note that these are regularly subject to change.

Successful applicants applying from abroad will be granted entry clearance for 33 months or 30 months if the application is made from inside the UK.

Applicants may then apply for a Spouse Visa Extension for a further 30 months. After 5 years you may be eligible to apply for Settlement / Indefinite Leave to Remain.

Spouse Visa Applications can be refused if they are not prepared properly. In line with aims to lower net migration, officials will refuse applications where they are not persuaded a requirement is satisfied or where a supporting document is missing. Fiance & Fiancee Visas

Fiance and Fiancée Visas are for people who are not married but are intending to get married in the UK.

The fiance or fiancee must intend to join their partner who is either a British Citizen or a person who is settled in the UK and must intend to get married within 6 months of entering the UK.

This visa is particularly useful for people who have friends and family in the UK who they want to attend their wedding but who would otherwise not be able to travel abroad for one reason or the other. It is also a good option for people who rather get married in the UK because of work commitments or some other reason, including any difficulties associated with travelling abroad.

We have represented many clients who have been concerned by the possible scenario of marrying abroad and being refused entry to live in the UK. The fiancé visa eradicates that concern because the rules allow someone on a fiancé visa to marry in the UK and then apply for an extension of leave to remain in the UK as a spouse for 30 months without leaving the UK.
