UK Expansion Worker Visa
The UK Expansion Worker Visa is designed for overseas businesses looking to establish their first commercial presence in the UK. It allows senior managers or specialist employees to come to the UK on a temporary basis to set up and support the expansion of an overseas company that does not yet actively trade in the UK. This can include preparing the business for trading, establishing a UK entity, and laying the operational foundations required for a successful market entry.
At BHD Solicitors, our immigration team provides clear, commercially focused UK Expansion Worker visa guidance for both overseas businesses and individual applicants. We advise on sponsor licensing, eligibility, compliance, and the visa application process from start to finish, with particular emphasis on addressing the areas most likely to attract Home Office scrutiny.
If you are planning a UK market entry or have been selected to lead your company’s expansion, early legal advice can be critical. Careful planning at the outset can help avoid refusal or delay, protect the credibility of the expansion strategy, and support a smoother transition into UK trading.

What is a UK Expansion Worker visa?
The UK Expansion Worker visa is part of the Global Business Mobility (GBM) route. It replaced the Sole Representative of an Overseas Business visa and is aimed at businesses that:
- Are established and trading overseas
- Do not yet have an active trading presence in the UK
- Intend to expand into the UK market
This route allows a limited number of senior or specialist employees to come to the UK to set up operations, such as registering a UK entity, securing premises, and preparing for trading.
Unlike some other business visas, this route does not lead directly to settlement, but it can form part of a longer-term UK immigration strategy.
Who can apply for a UK Expansion Worker visa?
An application involves two linked elements: the overseas business and the individual worker.
Overseas business
The overseas company must:
- Be legally established and actively trading overseas
- Have credible plans to expand to the UK
- Not already be trading in the UK (beyond a limited footprint)
- Obtain a UK Expansion Worker sponsor licence
Individual applicant
The worker must:
- Be a senior manager or specialist employee
- Be assigned to the UK to support the business expansion
- Meet the UK Expansion Worker visa requirements, including salary and skill thresholds

Our UK expansion worker visa services
Sponsor licence applications
We advise overseas companies at every stage of the sponsor licence process, starting with a clear assessment of eligibility and the viability of the proposed UK expansion. We work closely with clients to prepare robust and compliant expansion plans, anticipating the areas most likely to attract Home Office scrutiny.
Particular care is taken to address the “UK trading presence” requirement — a common ground for refusal — ensuring the business model, documentation, and timelines are aligned with Home Office expectations.
UK Expansion Worker visa applications
For individual applicants, we provide detailed eligibility assessments and careful checks of the Certificate of Sponsorship to minimise risk at an early stage. This includes reviewing role suitability, salary and skill level requirements, employment history with the overseas business, and compliance with Global Business Mobility rules.
We manage application drafting and evidence preparation in full, taking a structured and meticulous approach to presenting the application. Our focus is on ensuring that the role, the business expansion plan, and the applicant’s background are clearly aligned, reducing the risk of credibility concerns or requests for further information.
Where businesses operate across multiple jurisdictions or have non-standard ownership, governance, or management arrangements, we take particular care to explain these structures in a clear and logical way. By anticipating areas of potential Home Office concern, we ensure that complex corporate or employment arrangements support, rather than undermine, the strength and credibility of the application.
Business expansion and compliance advice
Our support extends beyond initial applications. We advise businesses on ongoing sponsor compliance obligations and help implement the systems and processes required from the outset.
As UK trading activity develops, we provide strategic advice on transitioning to alternative visa routes, as well as wider workforce planning and long-term immigration strategy.
Our approach is commercial, pragmatic, and aligned with your wider business objectives.

UK Expansion Worker Visa FAQs
Does the sponsoring overseas business need to already have a UK trading presence?
No. The overseas business must not yet be trading in the UK.
However, it may have a limited UK footprint, such as:
- A registered UK entity
- A UK bank account
- Initial market research or contractual discussions
If the Home Office considers that the business is already trading in the UK, the sponsor licence — and all linked visa applications — may be refused.
How long is the UK Expansion Worker Visa valid for, and can it be extended?
The visa is granted for:
- 12 months, or
- The length of the Certificate of Sponsorship plus 14 days (whichever is shorter)
It can be extended up to a maximum of two years under this route.
Time spent on this visa does not count towards settlement, but switching into another visa category may be possible once the UK business is trading.
What are the minimum salary and skill level requirements?
The role must:
- Be at RQF Level 6 or above (graduate level)
- Pay at least £45,800 per year, or the going rate for the role (whichever is higher)
Incorrect role classification or salary calculations are common reasons for refusal.
Can I bring dependants with me?
Yes. You can bring:
- A spouse or partner
- Dependent children under 18
Dependants can work (with limited exceptions) and study in the UK, subject to financial and relationship requirements.
How long must I have worked for the overseas business before applying?
In most cases, the applicant must have been employed by the overseas business for at least 12 months.
Exemptions may apply for high earners or particularly senior or specialist roles. This is a technical area where early advice is recommended.
How long does it take to get a decision?
Typical timescales are:
- Sponsor licence: around 8 weeks (priority services may be available)
- Visa application: around 3 weeks from biometrics (outside the UK)
Delays are common where credibility or compliance issues arise.
What are the eligibility requirements?
To be eligible, the applicant must:
- Hold a valid Certificate of Sponsorship
- Have worked for the overseas business for at least 12 months (unless an exemption applies)
- Be paid at or above the minimum salary threshold
- Undertake a role at the required skill level
- Meet English language, financial, and general immigration requirements
The Home Office assesses both the genuineness of the role and the credibility of the expansion plans, making careful preparation essential.
