Migrant Victims of Domestic Abuse

New Migrant Victims of Domestic Abuse Concession and Appendix Victim of Domestic Abuse

The concession provides a short period of independent immigration status and financial support to certain partners who are victims of domestic abuse, allowing them to leave the abusive relationship to position of support.

A three-month period of permission to stay is granted to the victim, with permission to work and access public funds. During this period, the victim must apply for permission to stay in an appropriate route, apply to settle in the UK when eligible under Appendix Victim of Domestic Abuse or make arrangements to leave the UK.

The concession previously only covered victims of domestic abuse inside the UK with permission as a partner under Appendix FM, this has now been expanded to include partners of those on work routes, student routes and the graduate route. Although now covered by the concession, applicants on these routes will not be eligible to apply for settlement under Appendix Victim of Domestic Abuse.

The new Appendix Victim of Domestic Abuse allows settlement where the applicant has or was last granted permission as a partner on a specified route and the relationship has permanently broken down due to domestic abuse. The applicant must apply from inside the UK unless abandoned overseas.
