New Unmarried Partner Immigration Rules

There are three ways to qualify as a ‘partner’ to be eligible to apply under Appendix Family Member of the Immigration Rules:

  1. As a Spouse
  2. As a Civil Partner
  3. As an Unmarried Partner

The definition of ‘Unmarried Partner’ in the Immigration Rules has now changed.

Previously, unmarried partners were required to live together for at least 2 years prior to making their applications. The new changes remove this onerous requirement.

An Unmarried Partner is now required to have been in a relationship similar to marriage or civil partnership for at least 2 years. This welcome change now permits applicants living apart for reasons such as work, study and cultural reasons to apply. Applicants must still demonstrate that their relationship is genuine and subsisting.
